On June 11, 2003, Watkins Ludlam Winter & Stennis sent out a Newsflash advising its clients that the Louisiana House and Senate had passed House Bill 1770 33 - 1 which amends Louisiana's non-compete statute, La. R. S. 23:921.* The bill, which was headed to Governor Mike Foster's desk for signature, was signed into law on June 18, 2003, and will become effective August 15, 2003. Employers should take note that, in order to take advantage of the new amendment (which gives Louisiana employers the right to restrict their employees from working for competing businesses), employers will need to enter into new non-compete agreements executed after August 15, 2003. Please feel free to contact any of WLW&S's Louisiana Labor and Employment attorneys, Topper Thompson, Jeffrey Schwartz, Audrey Browne or Susan Desmond, for assistance in drafting or redrafting non-compete agreements.
